1. Introduction

These Terms of Service ("Terms") govern your access to and use of braziliantanclub.com (the "Site") and any purchase you make through it. The Site is operated by S. LIMA DA SILVA LTDA (CNPJ 18.596.793/0002-08), registered at Av. Levy Ramos Martins, 6920, Sala 3, Nova Brasíllia, Imbituba, SC, CEP 88780-000, Brazil ("Brazilian Tan Club," "we," "us," "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract to place an order on the Site.

3. Products, Pricing & Availability

We strive to display accurate product descriptions, images, and prices, but errors may occasionally occur. We reserve the right to correct any pricing or typographical errors, and to cancel any order arising from such an error, even after an order has been submitted or confirmed, with a full refund of any amount charged. Prices are shown in the currency indicated at checkout and do not include applicable taxes, duties, or shipping unless stated otherwise. All products are subject to availability.

4. Orders & Acceptance

Your placement of an order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or unavailability of stock. A contract is formed only once we send you a shipping confirmation.

5. Payment

Payment is processed at the time of order through the payment methods available at checkout. You represent that you are authorized to use the payment method provided.

6. Returns, Refunds, Shipping & Cancellations

Our Return, Exchange, Refund & Cancellation Policy and Shipping Policy, available on the Site, are incorporated into these Terms by reference.

You may not reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to submit false or misleading information, or to infringe the rights of others, including through content you submit (such as reviews).

The Site may contain links to third-party websites. We do not endorse and are not responsible for the content, products, or practices of any third-party site.

12. Consumer Rights

Nothing in these Terms affects any statutory rights you have as a consumer under the mandatory laws of your country of residence, including (without limitation) the EU Consumer Rights Directive 2011/83/EU, the UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, and applicable consumer protection statutes in your Latin American country of residence, each of which prevails over any conflicting provision in these Terms to the extent required by law.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share your personal information.

14. Governing Law & Disputes

These Terms are governed by the laws of Brazil, without regard to conflict-of-law principles, except that if you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, the mandatory laws of your country of residence will apply to the extent they provide greater protection, and you may bring proceedings in the courts of your country of residence. EU/UK consumers may also contact the alternative dispute resolution (ADR) body applicable in their country; the European Commission's ODR platform was discontinued on 20 July 2025 and is no longer available. A directory of ADR bodies is available at consumer-redress.ec.europa.eu.

15. Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted on the Site, with the "Last updated" date revised accordingly. Continued use of the Site after changes constitutes acceptance of the updated Terms.
